This personal injury claim involved a 40-year old woman who was at an all-day company event in Temecula. Salad and sandwiches with lettuce had been served for lunch. Later that afternoon, Mayra went to use the restroom.

At pre-trial settlement, the defense offered our client an injury settlement amount of $100k. At that point we had already incurred in approximately $45k in expenses, so the insulting offer made it very easy for us to decide to try the case.

Mr. Ibarra represented an injured motorcyclist who sustained a serious left-hand fracture. The client had been a drummer for various rock bands for over 25 years. He will likely live with a metal plate and screw in his left hand for the rest of his life.

State Farm originally denied the claim despite the police report putting the defendant 100% at fault. After Mr. Ibarra’s involvement, State Farm tried to claim that our client was 75% at fault. This was unacceptable and not supported by the law or the facts.

Mr. Ibarra was annoyed by the low offer of $17,000 and immediately filed a lawsuit in the Los Angeles Superior Court. At the time of deposition, Mr. Ibarra served State Farm’s attorney with a “998” offer to compromise for the policy limits of $100,000.

The offer was accompanied by a persuasive cover letter detailing the major flaws in State Farms prior positions. The letter provided a lengthy analysis explaining how the accident and resulting surgery to the plaintiff’s hand directly impacted his work performance at a job where he was earning about $105,000 per year. About 3 months after the accident, he was terminated from his employment.

Mr. Ibarra and his team subpoenaed the employment records of the plaintiff and it was therein that it was discovered that the company’s internal e-mails supported the plaintiff’s position that his decline in work performance due to the accident and hand injury ultimately caused his termination.
